FACTS. - Dowell performed oil well fracturing services for Del-Rio in an attempt to increase production from a Del-Rio well.
The well thereafter ceased to produce at all. Del-Rio did not pay fully for the services. PROCEEDINGS. - Dowell sued to collect its bill; Del-Rio claimed an offset, alleging negligence by Dowell in damaging the
well. Interrogatories disclosed that the jury found both Dowell and Del-Rio negligent in causing the well to cease producing,
but did not find that Dowell proximately caused the cessation. Judgment was entered for Dowell, and Del-Rio appealed. A transcript
was never provided.
